Hennepin County FELA/FSAA Defense Verdict for Haws-KM

Haws-KM earned a defense verdict on March 26, 2024, in an injury case brought by a railroad worker against the Railroad under the FELA (Federal Employes’ Liability Act) and FSAA (Federal Safety Appliance Act). The Plaintiff claimed he was permanently disabled from returning to his work as a Conductor, after he was injured during the manual alignment of a railcar’s misaligned drawbar. He claimed the railroad was negligent in its training, failure to provide proper tooling, and in failing to provide a safe workplace. Plaintiff also claimed the misaligned drawbar was a defect under the FSAA. The jury disagreed on all counts, finding no violation of the FSAA and no negligence by the Railroad under the FELA. After over three hours of thoughtful deliberation, the Hennepin County jury returned a resounding victory for the defense.
