HAWS-KM Secures Favorable Decision at the Minnesota Supreme Court

HAWS-KM attorneys Kelly Hadac and Mike Mather recently secured a favorable decision on behalf of a firm client before the Minnesota Supreme Court. After the district court granted the firm’s client summary judgment on a promissory note, the defendant requested that the court stay entry of judgment pending resolution of a separate lawsuit between the same and additional parties. The district court granted the defendant’s motion, finding sufficient commonalities between the two cases to merit a stay.

HAWS-KM responded by petitioning for a writ of mandamus, first in the court of appeals and later, the Minnesota Supreme Court.  An issue of first impression, the Court was asked whether the Minnesota Rules of Civil Procedure granted the district court discretion to enter its stay.  After briefing and argument, the Court held the district court did not have this authority and ordered the stay lifted and judgment entered in favor of HAWS-KM’s client.
