Wisconsin Supreme Court Upholds Asbestos Verdict Against Facility Owner Under ‘Safe Place Statute’

The Wisconsin Supreme Court has upheld the 2021 Lorbiecki asbestos verdict against Pabst Brewing Co. under Wisconsin’s Safe Place Statute. The Court reaffirmed the heightened, non-delegable duty under the Safe Place Statute for employers and facility owners to “do every other thing reasonably necessary to protect the life, health, safety, and welfare of such employees and frequenters.” The Court did, however, reduce the punitive damages award levied against Pabst....
